William H. Parish PC Represents Female Employees in Contra Costa County Sexual Harassment and Retaliation Suit
WILLIAM H. PARISH PC has been retained to represent two female employees – one current and one former – of Contra Costa County’s Reclamation District 799, responsible for maintaining the 8.9 miles of levees between Oakley and Bethel Island. The employees have sued the district and two of its male board members, alleging sexual discrimination and retaliation.
Parish Recovers $1.4 Million for Corporate Directors’ Breach
WILLIAM H. PARISH PC represented a local corporation who sued its former directors and officers for breaching their fiduciary duties. While managing the corporation, the directors and officers allowed over $1.2 million to be embezzled by the former corporate bookkeeper. Mr. Parish recovered the full $1.2 million that was taken, plus interest, for a total award of $1.4 million to the corporation. The corporate shareholders were fully compensated for their loss.
William H. Parish Retained as Trial Counsel in Securities Case
Current and former NFL players including five quarterbacks filed a lawsuit against UBS Securities and former executives of Pay By Touch alleging fraud and negligent misrepresentation.
According to the complaint filed, “UBS Securities touted the Company (Pay By Touch) to investors as providing secure, convenient electronic transaction solutions for businesses and consumers through biometric authentication services and payment processing services.” Investors were told that its new unique payment system would reduce fraud, reduce payment transaction times, strengthen customer loyalty programs, and increase sales volume.
To fund the Company’s enormous capital requirements, UBS raised money for Pay By Touch through private offerings from prominent hedge funds, venture capitalists, and private investors. At least $300 million was invested in Pay By Touch during its short history. UBS received millions of dollars in placement fees.
“Defendants also falsely represented that they had disclosed all material risks to investors, and at the same time, UBS stated that they had not investigated the truth of their misrepresentations. The intent of the scheme was to induce Plaintiffs to rely on the misrepresentations and omissions and to invest in Pay By Touch,” the complaint alleges.
The suit alleges that the founder of Pay By Touch, John Rogers, had a string of run-ins with the law in his past. Rogers’ legal troubles included criminal misconduct, tax liens and civil judgments. Rogers was arrested for domestic assault and also had restraining orders on him. Rogers spent time in jail.
The suit says the former executives of Pay By Touch and UBS Securities also tried to withhold from investors, the findings of a confidential Federal Deposit Insurance Corporation (FDIC) report. The FDIC investigated the payment processing facility of Pay By Touch and concluded that its management had allowed serious problems to persist. Yet, despite knowing about these findings, the former executives of Pay By Touch and UBS Securities continued to hide the investigation from investors and instead suggested that no investigation had ever occurred. “Incredibly, Defendants told investors that they could be subject to investigation by a regulatory body regarding its payment processing facility, but decided not to reveal that they had been investigated or been told that they might not be able to process payments with federally-insured institutions.”
The fraud lawsuit was filed in San Francisco Superior Court and settled on the first day of trial.
William H. Parish Recovers Nearly $6 Million for Linden, California Walnut Grower
William H. Parish represented Brittalia Ventures, a Linden California walnut grower, in a jury trial to recover damages arising from crown gall infection. The jury awarded nearly $4.5 million in the first case in California to establish that a commercial nursery delivered root stock infected with this devastating disease. Three years later, the California Court of Appeal affirmed the jury’s verdict and Brittalia Ventures was paid the original award plus interest, totaling nearly $6 million. The Court of Appeal’s decision may be found at Brittalia Ventures v. Stuke Nursery, Inc., 153 Cal. App. 4th 17 (2007).
City of Oakdale Wins Contract Dispute
A real estate developer sued Oakdale alleging that the developer was entitled to payment of almost $500,000 for unused development credits. The developer’s claims were rejected at trial and Oakdale obtained a complete defense. William H. Parish was trial counsel.
Parish Retained to Represent Local Attorney
Our firm has been retained to represent a prominent local attorney in litigation arising from the dissolution of a law practice. The case settled on favorable terms on the second day of trial.

Complex Real Estate Lien Case Confirms Client’s Rights to Enforce Multi-Million Dollar Lien
Our client owns a multi- lien against real estate. The owner of the property filed a declaratory relief action seeking to subordinate our client’s lien, effectively rendering the lien unenforceable. The Court granted our motion for summary judgment confirming our client’s right to enforce the lien. William H. Parish was counsel on the case.
Farmer Recovers Settlement Valued at Over $1.7 Million for Breach of Contract
We were retained to represent a farmer in United States District Court to recover damages for breach of contract for the sale of farm land. We obtained summary adjudication of all facts, except one damage issue. The case settled two days before trial of the remaining damage issue. The settlement compensated our client for all damages, attorneys’ fees and costs incurred in the case. William H. Parish was counsel on the case.
Bank Retains Parish to Enforce Multi-Million Dollar Lending Claims
Our firm was retained by Bank to enforce multi- lending claims and to defend the borrowers’ claims of fraud. At the conclusion of the lead plaintiff’s deposition, the plaintiffs agreed to a settlement, dismissing all claims against the Bank and agreeing to a repayment plan on terms favorable to Bank. William H. Parish was lead counsel on the case.
Judgment Dismissing Claims for Breach of Contract and Fraud Affirmed on Appeal
We represented a real estate development company and its owner who were sued for breach of contract and fraud. After a three-week jury trial, we obtained a judgment in favor of our client and the plaintiffs appealed. The Court of Appeal confirmed that, as a matter of law, our client did not do anything wrong. William H. Parish PC was trial and appellate counsel.
Parish Recovers $3.2 Million for Investment Fund
We represented an investment fund that had made an investment deposit of $3,000,000, subject to the fund reviewing and approving the company’s organizational structure and investment plan. The company, however, began spending the deposit without the fund’s approval. We recovered the full deposit of $3 million dollars, plus $200,000 for attorney’s fees and interest. William H. Parish was lead attorney on the case.
Parish Wins Summary Judgment in Bank Dispute
William H. Parish represented a local community bank in a lawsuit to enforce the terms of a letter of credit issued by a Southern California Bank. The Court granted summary judgment in favor of our client, rejecting the defendant’s claim that defendant was not obligated to honor the demand for payment. The $300,000 judgment was paid in full.
Developer Wins Summary Judgment in Contract Dispute
Our firm was retained by Frontier Community Builders to defend the company in a lawsuit seeking to rescind a real estate development contract. We obtained a summary judgment, dismissing the case without trial. The court awarded our client all of its attorney’s fees expended to defend the case. William H.
