The developer’s claims were rejected at trial and Oakdale obtained a complete defense.

William H. Parish PC Wins Landmark Appeal

Ahcom, Ltd. v. Smeding, 623 F.3d 1248 (9th Cir. 2010), counsel for plaintiff. William H. Parish acted as appellate counsel in this landmark decision. The decision overrules several decades of decisions of the Ninth Circuit Bankruptcy Appellate Panel that held that when a California corporation filed for bankruptcy protection, only the bankruptcy trustee had standing to pursue a “generalized claim for alter-ego liability.” The decision prevents shareholders of bankrupt corporations from using the bankruptcy laws to bar alter-ego claims asserted by corporate creditors.

Gold Strike Heights Homeowners Association v. Westwind Development, Inc., Calaveras County and California Third Appellate District, counsel for defendants. Our client, a real estate developer and its principal owner, was sued for breach of contract and alter ego claims. After a three week jury trial, the trial court granted a judgment notwithstanding the verdict and vacated the jury’s award. The Court of Appeal affirmed the trial court’s ruling and awarded our client costs and attorneys’ fees for successfully defending the action.

Galli Properties, Inc. v. Galli, San Joaquin County Superior Court. William H. Parish PC represented a local corporation who sued its former directors and officers for breaching their fiduciary duties. While managing the corporation, the directors and officers allowed over $1.2 million to be embezzled by the former corporate bookkeeper. Our team was successful in recovering the full $1.2 million that was taken, plus interest, for a total award of $1.4 million to the corporation. The corporate shareholders were fully compensated for their loss.

Chevron U.S.A.,Inc. v. IRA Administrators, Inc., San Joaquin County, counsel for defendant. Our client owns a multi-million dollar lien against real estate. The owner of the property filed a declaratory relief and quiet title action seeking to subordinate our client’s lien, effectively rendering the lien unenforceable. The Court granted our motion for summary judgment confirming our client’s right to enforce the lien. William H. Parish was counsel on the case.
