JKB Homes v. City of Oakdale, Stanislaus County Superior Court Case. William H. Parish PC defended the City of Oakdale in a suit brought by a real estate developer alleging that the developer was entitled to payment of almost $500,000 for unused development credits. The developer’s claims were rejected at trial and Oakdale obtained a complete defense.

Appeals

William H. Parish PC Wins Landmark Appeal

Ahcom, Ltd. v. Smeding, 623 F.3d 1248 (9th Cir. 2010), counsel for plaintiff. William H. Parish acted as appellate counsel in this landmark decision. The decision overrules several decades of decisions of the Ninth Circuit Bankruptcy Appellate Panel that held that when a California corporation filed for bankruptcy protection, only the bankruptcy trustee had standing to pursue a “generalized claim for alter-ego liability.” The decision prevents shareholders of bankrupt corporations from using the bankruptcy laws to bar alter-ego claims asserted by corporate creditors.

William H. Parish PC Achieves Judgment Dismissing Claims for Breach of Contract and Fraud; Affirmed on Appeal

Gold Strike Heights Homeowners Association v. Westwind Development, Inc., Calaveras County and California Third Appellate District, counsel for defendants. Our client, a real estate developer and its principal owner, was sued for breach of contract and alter ego claims. After a three week jury trial, the trial court granted a judgment notwithstanding the verdict and vacated the jury’s award. The Court of Appeal affirmed the trial court’s ruling and awarded our client costs and attorneys’ fees for successfully defending the action.

Local Community Bank Receives $300,000 Judgment Following William H. Parish PC Representation

Community Bank of San Joaquin v. Pacific Capital Bank, N.A., San Joaquin County, counsel for plaintiff. William H. Parish represented a local community bank in a lawsuit to enforce the terms of a letter of credit issued by a Southern California Bank. The court granted summary judgment in favor of our client, rejecting the defendant’s claim that defendant was not obligated to honor the demand for payment. The $300,000 judgment was paid in full.

Local Corporation Receives $1.4 Million in Damages; Represented by William H. Parish PC at Trial

Galli Properties, Inc. v. Galli, San Joaquin County Superior Court. William H. Parish PC represented a local corporation who sued its former directors and officers for breaching their fiduciary duties. While managing the corporation, the directors and officers allowed over $1.2 million to be embezzled by the former corporate bookkeeper. Our team was successful in recovering the full $1.2 million that was taken, plus interest, for a total award of $1.4 million to the corporation. The corporate shareholders were fully compensated for their loss.

William H. Parish PC Wins Summary Judgment in Multi-Million Dollar Lien Case

Chevron U.S.A.,Inc. v. IRA Administrators, Inc., San Joaquin County, counsel for defendant. Our client owns a multi-million dollar lien against real estate. The owner of the property filed a declaratory relief and quiet title action seeking to subordinate our client’s lien, effectively rendering the lien unenforceable. The Court granted our motion for summary judgment confirming our client’s right to enforce the lien. William H. Parish was counsel on the case.

Building Company Successfully Avoids Trial in Contract Case; Represented by William H. Parish PC

Dutra v. Frontier Community Builders, San Joaquin County, counsel for defendant. Our firm was retained by Frontier Community Builders to defend the company in a lawsuit seeking to rescind a real estate development contract. We obtained a summary judgment, dismissing the case without trial. William H. Parish PC represented Frontier Community Builders in the case.
